The papers read at the Semaine des Intellectuels Catholiques of 1958 are here gathered together in the eleventh volume of what is surely one of the most notable French series to appear since the war. Philosophy, history, science law and politics all provide their quota of savants to contribute to a symposium on nationalism viewed from the Christian standpoint. While the word nation can boast of a centuriesold usage not far removed from the modern meaning, the term nationalism first appears (...) at the end of the eighteenth century. For a century and a half it has been perhaps the greatest driving force in world history, and though many would hold that its race is now run in Europe, it is still only getting into its full stride in Africa and Asia. An ideology so alluring and obstinate certainly deserves the closest attention of contemporary Catholic thinkers. (shrink)

Dr. McCracken’s book is partly historical and partly analytical. It opens with as good a summary of Irish history from the founding of the Gaelic League in 1893 until the general election of 1918 as one could wish for. The resounding victory won by Sinn Féin in 1918 prepared the way for the first and second Dáil, whose membership is here analysed from the standpoints of age, religion, education and occupation with some interesting results. As the later parliaments are given (...) similar treatment we may use them here as a basis of comparison in our summary of Dr. McCracken’s results from 1919-21. (shrink)

Law and ethics or a sense of professional responsibility are not always aligned. A characterization of the disconnect falls into one of two broad categories. At times, the law may not go far enough in achieving an ethical or professional response, at other times the law goes too far and forecloses a response based on ethical principles or professional responsibility. In the instance of the latter, ownership or control rights often conflict with other rights such as access to information, privacy, (...) or a general sense of free speech. Where the law does not go far enough an opportunity arises for gentle intervention through education and awareness-raising. The law can, however, be said to align with principles or responsibility, and while not perfect leads to a more harmonious and desirable response. Along these three characterizations the role of the information intermediary such as a library or school is examined. In addition, the characterization is assessed in three subject areas: copyright, privacy, and free speech. The discussion results in further opportunity for reflection on the purpose and role of law and preferred or professional responses. (shrink)

This paper discusses basic concepts and recentdevelopments in intellectual property ownership in theUnited States. Various philosophical arguments havepreviously been put forward to support the creation andmaintenance of intellectual property systems. However, in an age of information, access toinformation is a critical need and should beguaranteed for every citizen. Any right of controlover the information, adopted as an incentive toencourage creation and distribution of intellectualproperty, should be subservient to an overriding needto ensure access to the information. The principlesunderlying intellectual property regimes (...) in the UnitedStates recognize and embody this. In addition, thephilosophical/ethical dimensions of this debate couldalso be structured to support this attitude as well. Intellectual property is fast becoming digitalproperty. New technologies allow owners to extendtheir control of both legitimate uses and misuses ofthe intellectual property. Recent trends demonstratethat the access principle has not always beenparamount in judicial or legislative applications. Thetrend rather is to allow a proprietarianism factor todominate the analysis. Finally, several principles areforwarded which would assist adjudicators and policymakers in reaffirming the basic purpose of theintellectual property law, which is to benefit thepublic at large. This article explores recent developments inthe regulation of Internet speech, inparticular, injurious or defamatory speech andthe impact the attempts at regulation arehaving on the `body' in the sense of theindividual person who speaks through the mediumof the Internet and upon those harmed by thatspeech. The article proceeds in threesections. First, a brief history of the legalattempts to regulate defamatory Internet speechin the United States is presented; a shortcomparative discussion of defamation law in theUK and Australia is included. As discussedbelow, this (...) regulation has altered thetraditional legal paradigm of responsibilityand, as a result, creates potential problems forthe future of unrestricted and even anonymousspeech on the Internet. Second, an ethicalassessment is made of the defamatory speechenvironment in order to determine which actorshave moral responsibility for the harm causedby defamatory speech. This moral assessment iscompared to the developing and anticipatedlegal paradigm to identify possible conformityof moral and legal tenants or to recognize theconflict between morality and law in assigningresponsibility to defamatory actors. Thisassessment then concludes with possiblesuggestions for changes in the legal climategoverning the regulation of defamatory speechon the Internet, as well as prediction of theresult should the legal climate continue todevelop on its present course. This is not tosuggest that all law, or even the law ofdefamation, be structured to reflect thesubjectivity of a moral construct, but since itis the authors position that the legalassignment of liability in online settings ismisaligned, this reflection can serve asbeginning reassessment of that assignment. As the National Information Infra- structure develops new avenues for information products and services will open. Creating, identifying and protecting the information market space is a critical component to the success of information product and service developments. As a result, the producers of those products and service seek to protect their proprietary interest in the underlying information. However, these actions have broader consequences: Attempts to extend legal protection to basic facts and other public domain information demonstrate that the public information (...) space is slowly being reduced. Reviewing several information controversies as case studies is fruitful. Not only for assessing current trends in information disputes (warfare) but can form the basis for establishing several predictors useful in determining when future information ownership controversies may develop and result in the loss of public information space. One set of predictors helps define the information controversy and is descriptive. The second set of predictors characterizes the marketplace environment. It provides further nuance to the economic factors that force information owners to seek legal remedy. Identifying instances where both models suggest a change in information rights or ownership is most likely to result in the critical loss of access to public information space. (shrink)

The present paper was written as a contribution to ongoing methodological debates within the NCC project. We focus on the neural correlates of conscious perceptual episodes. Our claim is that the NCC notion, as applied to conscious perceptual episodes, needs to be reconceptualized. It mixes together the processing related to the perceived contents and the neural substrate of consciousness proper, i.e. mechanisms making the perceptual contents conscious. We thus propose that the perceptual NCC be divided into two constitutive subnotions. The (...) main theoretical idea that emerges as a consequence of this reconceptualization is that the neural correlate of a perceptual episode is formed in the neural interaction between content-processing and consciousness-conferring mechanisms. The paper elaborates this distinction, marshals some initial arguments in its favour, and tests it against some of the most debated theories of consciousness. (shrink)

Two important questions arise concerning the properties that constitute the phenomenal characters of our experiences: first, where these properties exist, and, second, whether they are tied to our consciousness of them. Such properties can either exist externally to the perceiving subject, or internally to her. This article argues that phenomenal characters, and specifically the phenomenal characters of colours, may exist independently of consciousness and that they are internal to the subject. We defend this combination of claims against a recent criticism (...) according to which the unconscious phenomenal character of colours exists externally to the subject. We defend internalism about (potentially unconscious) phenomenal character by appealing to recent neuroscientific and behavioural evidence, and by rejecting the claim that externalism about phenomenal character is dialectically in a better position than internalism. In addition, we briefly present certain difficulties for externalist views of phenomenal character. These concern cases where the perceptual relation fails, but a perceptual experience still results. These points suffice to defuse the externalist critique of our view, and support the internalist variant of the consciousness-independence claim as the most plausible account of the unconscious phenomenal character of colours. První z těchto prací se přesvědčivě pokouší vyvrátit populární relativistické a konstruktivistické teze, zatímco ta druhá předkládá obhajobu specifické formy relativismu zaměřené na filosofické propozice.

We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

Diversas cuestiones surgen acerca de la relación de semejanza: (1) ¿Presuponen los “respectos” de semejanza un universal? (2) ¿Induce un regres vicioso el hecho de que la relación de semejanza sea una relación? (3) Si hay diferentes respectos de comparación entre tropos, entonces hay espacio para las dificultades tradicionales contra el nominalismo de semejanza: la “comunidad imperfecta” y la “compañía”. ¿Pueden ser manejados estos problemas con clases (...) de tropos semejantes? (4) La relación de semejanza requerida es una “semejanza perfecta”, esto es, una relación de semejanza transitiva, sin margen para grados y sin variación en los respectos de comparación entre tropos. ¿Hay clases de tropos exactamente semejantes? Después de consideradas estas cuestiones, parece que el defensor de los tropos tiene respuestas para las cuestiones (1), (2) y (3), pero parece no haber respuestas plausibles para la cuestión (4). Las clases de semejanza perfecta que van a reemplazar a los universales deben ser clases de tropos posibles y no hay formas razonables de explicar los hechos modales requeridos para estos tropos. Predictive Processing theory, hotly debated in neuroscience, psychology and philosophy, promises to explain a number of perceptual and cognitive phenomena in a simple and elegant manner. In some of its versions, the theory is ambitiously advertised as a new theory of conscious perception. The task of this paper is to assess whether this claim is realistic. We will be arguing that the Predictive Processing theory cannot explain the transition from unconscious to conscious perception in its proprietary terms. An experimental, conceptually driven foray into the Patrician field, Ireland’s ubiquitous national apostle – a former captive – is utilised as a vehicle through which to explore a trinity of salient and interrelated themes within the Catholic and Protestant hinterlands of the Irish imagination: visions of imprisonment; of the island; and of imperialism. The reader is guided through aspects of Patrician literature, visits the island’s hallowed Patrician shrines, and is thus shown Purgatory. Insights into the imaginations exhibited by a range (...) of influential Irish ideologues and intellectuals – Gerry Adams; J.B. Bury; John Hume; Eóin MacNeill; Michael McCarthy; John Mitchel; Peadar O’Donnell; Tomás Ó Fiaich; John Ryan; William Ryan; Ian Paisley; Patrick Pearse; Oscar Wilde – are generated. The cognitive (and conspicuously Platonic) terraforming of the prison-cell into an island, and of the island into a giant prison – of either British or Vatican construction – that recurs in much Irish political thought and reflection, is observed. The concluding section involves historiographical reflection: Bury’s, and by extension St. Patrick’s, influence with regards the development of the discipline of Irish history is highlighted. That the island exhibits a distinctive intellectual micro-climate, one in which visions of Patrick act as a formidable ideological force, is implicit throughout. (shrink)

The chapter discusses the rejuvenation of an interest in Mach in the recent metaphysics and philosophy of mind. In the early twentieth century, Mach had been interpreted as a phenomenalist, but phenomenalism fell out of favor in the 1950s. In the later decades, he received praise for his naturalism, but his contributions to metaphysics or philosophy of mind were regarded as misbegotten or irrelevant. With the search for a monistic alternative to both materialism and dualism in the recent philosophy of (...) consciousness, however, Mach attracts a fresh attention. For example, the contemporary philosopher Sam Coleman develops a version of a monistic metaphysic called “panqualityism,” which resembles Mach’s view to a large extent. Like most contemporary monists, however, Coleman works much more closely from Russell’s The Analysis of Matter, than Mach’s The Analysis of Sensations. The chapter details the circumstances that have led to the recent rise of monism; the varieties of Russellian monism; Coleman’s panqualityism; and the similarities and differerences between panqualityism and Machian monism. In early April 1911 Albert Einstein arrived in Prague to become full professor of theoretical physics at the German part of Charles University. It was there, for the first time, that he concentrated primarily on the problem of gravitation. Before he left Prague in July 1912 he had submitted the paper "Relativität und Gravitation: Erwiderung auf eine Bemerkung von M. Abraham" in which he remarkably anticipated what a future theory of gravity should look like. At the occasion of the Einstein-in-Prague (...) centenary an international meeting was organized under a title inspired by Einstein's last paper from the Prague period: "Relativity and Gravitation, 100 Years after Einstein in Prague". The main topics of the conference included: classical relativity, numerical relativity, relativistic astrophysics and cosmology, quantum gravity, experimental aspects of gravitation, and conceptual and historical issues. The conference attracted over 200 scientists from 31 countries, among them a number of leading experts in the field of general relativity and its applications. This volume includes abstracts of the plenary talks and full texts of contributed talks and articles based on the posters presented at the conference. These describe primarily original results of the authors. The article presents the contemporary situation of teaching ethics in secondary schools in Spain. It highlights the historical and systemic contexts related to the introduction of this subject into the curriculum in the 1980s, as well as its position in the curriculum as an alternative to religious education. It also diagnoses problems and deficits resulting from multiple legislative changes, inconsistent and instrumental treatment of this subject by legislators and its still visible undervaluation in the Spanish education system. Finally, it proposes (...) a number of practical solutions related to the methodology of teaching ethics and the role that a teacher can play in the education process. These suggestions are an attempt to respond to the assumptions formulated by law regarding the objectives of teaching the subject “Ethical Values”, and above all, they emphasize the close connection of ethics with the development of civic attitudes, practical development of critical thinking skills, responsibility, and autonomy. ABSTRACT:Giving without the expectation of reward is difficult to understand in organizational contexts. In opposition to a logic based on self-interest or a sense of duty, a “logic of gift” has been proposed as a way to understand the phenomenon of free, unconditional giving. However, the rationale behind, and effects of, this logic have been under-explored. This paper responds by first clarifying the three logics of action—the logic of exchange, the logic of duty, and the logic of gift—and then explains (...) how their balanced integration promises to enhance organizational life and outcomes. Having explicated the unique character and contributions of the logic of gift, the paper further suggests practical implications for management. Encouraging the logic of gift fosters more humane relationships within organizations and to enable individuals to be generous in ways that inspire trust and promote creativity. (shrink)

The present article revolves around the notion of universality and its relation to freedom and temporal orientation in contemporary political thought, with a focus on Susan Buck-Morss' notion of universality. The purpose is twofold. Firstly, I discern and critique the historico-political premises of her approach. Secondly, I suggest an alternative historico-political approach to universality addressing the drawbacks of her approach. I present three objections to her approach. Drawing on Arendt's distinction between liberation and the practice of freedom, I first present (...) a critique of the conceptualisation of freedom on which Buck-Morss' approach hinges, arguing that she overemphasises the moment of liberation. Thereafter, I turn to her reflections on historical orientation. My third objection concentrates on Buck-Morss' concept of universality. As a heuristic tool to expound on my critique, I activate the distinction between fictive and ideal universality as suggested by Étienne Balibar. I contend that Arendt's distinction between liberation and the practice of freedom efficiently elucidates the questions at stake in Balibar's discussion, as well as how his distinction points to the limits of Buck-Morss' argumentation. Ultimately, I contend that these critical remarks open up for a more dialectical approach to universality as a historical-political problem. (shrink)

The Continuous Parameter Estimation Model is applied to develop individual genomic-level heritabilities for the latent hierarchical structure and developmental dynamics of Life History (LH) strategy LH strategies relate to the allocations of bioenergetic resources into different domains of fitness. LH has moderate to high population-level heritability in humans, both at the level of the high-order Super-K Factor and the lower-order factors, the K-Factor, Covitality Factor, and General Factor of Personality (GFP). Several important questions remain unexplored. We developed measures of genome-level (...) heritabilities employing an American sample of 316 monozygotic (MZ) and 274 dizygotic (DZ) twin dyads and a Swedish sample of 863 MZ and 475 DZ twin dyads. This novel heritability index measures individual genetic transmissibility, therefore opening new avenues for analyzing complex interactions among heritable traits inaccessible to standard structural equations methods. For these samples: (1) moderate to high heritability of factor loadings of Super-K on its lower-order factors is demonstrated, evidencing biological preparedness, genetic accommodation, and the gene-culture coevolution of biased epigenetic rules of development; (2) moderate to high heritability of the magnitudes of the effect of the higher-order factors upon their loadings on their constituent factors, evidencing genetic constraints upon phenotypic plasticity; and (3) that heritability of the LH factors, of factor loadings, and of the magnitudes of the correlations among factors are weaker among those with slower LH speeds, demonstrating that inter-individual variation in transmissibility is a function of individual socioecological selection pressures. Critical congenital heart disease screening is rapidly becoming the standard of care in the United States after being added to the Recommended Uniform Screening Panel in 2011. Newborn screens typically do not require affirmative parental consent. In fact, most states allow parents to exempt their baby from receiving the required screen on the basis of religious or personally held beliefs. There are many ethical considerations implicated with allowing parents to exempt their child from newborn screening for CCHD. Considerations include the (...) treatment of religious exemptions in our current legal system, as well as medical and ethical principles in relation to the rights of infants. Although there are significant benefits to screening newborns for CCHD, when a parent refuses for religious or personal beliefs, in the case of CCHD screening, the parental decision should stand. This is an annotated translation of the first four chapters of the second book of Aristotle’s Prior Analytics. I aim to offer Portuguese-speaking readers a clear text with complementary materials to elucidate and contextualize Aristotle’s work, fulfilling a significant gap in the Lusophone bibliographical universe. To do this, I have taken Ross’s edition of the Aristotelian text as a basis – in which I have made some small changes – and compared my work with a series of existing translations and (...) commentaries on the text. This chapter describes the potential far‐reaching consequences of contemplative higher education for the fields of science and medicine.

Nursing is possible owing to a series of intricate systemic relations. Building on an established tradition of sociological research, we critically analysed the nursing profession in Chile, with an emphasis on its education system, in the light of social systems theory. The paper's aim was to explore basic characteristics of nursing education as a system, so as to outline its current evolution. Drawing on recent developments in nursing, we applied an empirical framework to identify and discuss functionally differentiated systems that (...) are relevant to nursing and observe communications between them. We found that the dynamics of nursing as a whole develop from communications with closely related systems, including the nursing profession and the education system more broadly. While the discipline (as a system of representations) strives to control the profession (as an applied occupational field), the necessities of practicing nurses imply other forces mediating the making of the profession, a process framed by market dynamics in education and health. In the recent literature on the nature of knowledge, a rivalry has emerged between modalism and explanationism. According to modalism, knowledge requires that our beliefs track the truth across some appropriate set of possible worlds. Modalists tend to focus on two modal conditions: sensitivity and safety. According to explanationism, knowledge requires only that beliefs bear the right sort of explanatory relation to the truth. In slogan form: knowledge is believing something because it’s true. In this paper, we aim to vindicate (...) explanationism from some recent objections offered by Gualtiero Piccinini, Dario Mortini, and Kenneth Boyce and Andrew Moon. Together, these authors present five purported counterexamples to the sufficiency of the explanationist analysis for knowledge. In addition, Mortini devises a clever argument that explanationism entails the violation of a plausible closure principle on knowledge. We will argue that explanationism is innocent of all these charges against it, and we hope that the strength of the defense we offer of explanationism is evidence in its favor, and a reason to investigate explanationism further as the long-elusive truth about the nature of knowledge. Conceptualization and measurement of organizational commitment involve different dimensions that include economic, affective, as well as moral aspects labelled in the literature as: ‘continuance’, ‘affective’ and ‘normative’ commitment. This multidimensional framework emerges from the convergence of different research lines. Using Aristotle’s philosophical framework, that explicitly considers the role of the will in human commitment, it is proposed a rational explanation of the existence of mentioned dimensions in organizational commitment. Such a theoretical proposal may offer a more accurate definition of ‘affective (...) commitment’ that distinguishes feelings from rational judgments. The use of a philosophical explanation coherent with psychological findings also allows the discovery of a wider moral concept of ‘normative commitment’. (shrink)

A review of Tomáš Pospiszyl’s Srovnávací studie.

Many philosophers believe that our ordinary English words man and woman are “gender terms,” and gender is distinct from biological sex. That is, they believe womanhood and manhood are not defined even partly by biological sex. This sex/gender distinction is one of the most influential ideas of the twentieth century on the broader culture, both popular and academic. Less well known are the reasons to think it’s true. My interest in this paper is to show that, upon investigation, the arguments (...) for the sex/gender distinction have feet of clay. In fact, they all fail. We will survey the literature and tour arguments in favor of the sex/gender distinction, and then we’ll critically evaluate those arguments. We’ll consider the argument from resisting biological determinism, the argument from biologically intersex people and vagueness, the argument from the normativity of gender, and some arguments from thought experiments. We’ll see that these arguments are not up to the task of supporting the sex/gender distinction; they simply don’t work. So, philosophers should either develop stronger arguments for the sex/gender distinction, or cultivate a variety of feminism that’s consistent with the traditional, biologically-based definitions of woman and man. Modalists think that knowledge requires forming your belief in a “modally stable” way: using a method that wouldn't easily go wrong, or using a method that wouldn't have given you this belief had it been false. Recent Modalist projects from Justin Clarke-Doane and Dan Baras defend a principle they call “Modal Security,” roughly: if evidence undermines your belief, then it must give you a reason to doubt the safety or sensitivity of your belief. Another recent Modalist project from Carlotta Pavese (...) and Bob Beddor defends “Modal Virtue Epistemology”: knowledge is a belief that is maximally modally robust across “normal” worlds. We'll offer new objections to these recent Modalist projects. We will then argue for a rival view, Explanationism: knowing something is believing it because it's true. We will show how Explanationism offers a better account of undermining defeaters than Modalism, and a better account of knowledge. (shrink)

In an essay recently published in this journal (“Is Safety in Danger?”), Fernando Broncano-Berrocal defends the safety condition on knowledge from a counterexample proposed by Tomas Bogardus (Philosophy and Phenomenological Research, 2012). In this paper, we will define the safety condition, briefly explain the proposed counterexample, and outline Broncano-Berrocal’s defense of the safety condition. We will then raise four objections to Broncano-Berrocal’s defense, four implausible implications of his central claim. In the end, we conclude that Broncano-Berrocal’s defense of the safety (...) condition is unsuccessful, and that the safety condition on knowledge should be rejected. (shrink)

Many contemporary epistemologists hold that a subject S’s true belief that p counts as knowledge only if S’s belief that p is also, in some important sense, safe. I describe accounts of this safety condition from John Hawthorne, Duncan Pritchard, and Ernest Sosa. There have been three counterexamples to safety proposed in the recent literature, from Comesaña, Neta and Rohrbaugh, and Kelp. I explain why all three proposals fail: each moves fallaciously from the fact that S was at epistemic risk (...) just before forming her belief to the conclusion that S’s belief was formed unsafely. In light of lessons from their failure, I provide a new and successful counterexample to the safety condition on knowledge. It follows, then, that knowledge need not be safe. Safety at a time depends counterfactually on what would likely happen at that time or soon after in a way that knowledge does not. I close by considering one objection concerning higher-order safety. Feminism has long grappled with its own demarcation problem—exactly what is it to be a woman?—and the rise of trans-inclusive feminism has made this problem more urgent. I will first consider Sally Haslanger’s “social and hierarchical” account of woman, resulting from “Ameliorative Inquiry”: she balances ordinary use of the term against the instrumental value of novel definitions in advancing the cause of feminism. Then, I will turn to Katharine Jenkins’ charge that Haslanger’s view suffers from an “Inclusion Problem”: it fails (...) to class many trans women as women. Jenkins offers a novel norm-relevancy account of woman to avoid the Inclusion Problem. Unfortunately, Jenkins’ account has serious internal problems, i.e. problems by Jenkins’ own lights: it is unintelligible, or it suffers from an Inclusion Problem of its own. After that, I will develop novel arguments for the conclusion that the project of Ameliorative Inquiry is both incoherent and also impossible to complete—at least, impossible to complete in a trans-inclusive way. Trans-inclusive feminism, therefore, would do well to move beyond Ameliorative Inquiry. Insofar as that’s not possible, trans-inclusive feminism inherits the incoherence of Ameliorative Inquiry. Do the facts of evolution generate an epistemic challenge to moral realism? Some think so, and many “evolutionary debunking arguments” have been discussed in the recent literature. But they are all murky right where it counts most: exactly which epistemic principle is meant to take us from evolutionary considerations to the skeptical conclusion? Here, I will identify several distinct species of evolutionary debunking argument in the literature, each one of which relies on a distinct epistemic principle. Drawing on recent work (...) in epistemology, I will show that most of these initially plausible principles are false, spoiling the arguments that rely on them. And we will see that each argument threatens only one popular view of moral psychology: a “Representationalist” view on which our moral judgments rely crucially on a mental intermediary—e.g. a sentiment, gut reaction, or affect-laden intuition—delivered by our evolved moral faculty. In the end, only one evolutionary debunking argument remains a menace: an “ Argument from Symmetry ” that I will introduce to the literature. But we will see that it should worry only all naturalists, pressuring them into a trilemma: give up moral realism, accept a rationalism that is incongruous with naturalism, or give up naturalism.
